Terms of Service (AGB)
1. Scope
These Terms of Service (“Terms”) govern all contracts, deliveries, and services between

(hereinafter “we”, “us” or “Hunter & Companion”),
and the customer (hereinafter “you” or “the customer”)
made via our website [www.myhunt-app.com].
Our offers are directed exclusively to consumers within the meaning of § 13 of the German Civil Code (BGB), unless explicitly stated otherwise.
2. Conclusion of Contract
(1) The presentation of products and services on our website does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the “Order” or “Buy now” button at the end of the checkout process, you make a binding offer to purchase the goods and/or services in your shopping cart.
(3) The purchase contract is concluded when we send you an order confirmation by e-mail or dispatch the goods, whichever occurs first.
(4) For subscription-based software or service (SaaS) components, the contract is concluded when your online registration and payment have been confirmed by us.
3. Prices and Payment
(1) All prices stated on the website are in euros and include statutory value-added tax (VAT) where applicable.
(2) Shipping costs, if any, will be displayed separately before the order is completed.
(3) Payment methods are shown during the ordering process. Payment must be made in advance using one of the available payment options.
4. Delivery and Shipping
(1) Unless otherwise stated, goods are shipped within 2 working days (Monday–Friday) after receipt of payment.
(2) We deliver to Germany and Austria.
(3) Delivery times depend on the destination and the carrier, and are typically:

Germany: 1–3 working days

Austria: 3–5 working days
(4) The goods remain our property until full payment has been received (§ 449 BGB).
5. Right of Withdrawal
Consumers have a statutory right of withdrawal as described in our separate Refund and Return Policy, which forms an integral part of these Terms.
6. SaaS Services and Subscriptions
(1) Some products include or require access to an online service provided by Hunter & Companion (SaaS).
The availability, duration, and price of such services are specified in the product description.
(2) The minimum contract period for SaaS subscriptions is one month unless otherwise stated.
(3) The contract may be terminated by either party with a notice period of one month to the end of the current billing period. Termination must be made in text form (e.g., e-mail).
(4) We may suspend access to the service if payment is not received or if there is misuse of the service.
(5) We are entitled to make technical changes or updates to the SaaS service where necessary for legal, security, or operational reasons.
7. Warranty (Gewährleistung)
(1) The statutory warranty provisions of §§ 434 et seq. BGB apply.
(2) The warranty period is two (2) years from the date of delivery.
(3) We do not grant any additional guarantees beyond the statutory warranty rights.
8. Liability
(1) We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
(2) In the event of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable and typical damages.
(3) Any further liability is excluded.
9. Retention of Title
The delivered goods remain our property until full payment of the purchase price has been received.
10. Applicable Law and Jurisdiction
(1) Contracts concluded under these Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If you are a consumer residing in another EU member state or Switzerland, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
(3) The place of jurisdiction for all disputes arising from contractual relationships is Munich, Germany, if the customer is a merchant, legal entity under public law, or special fund under public law.
11. Dispute Resolution
We are neither willing nor obliged to participate in dispute settlement proceedings before any consumer arbitration board.
